Terms of Service
Terms for using Tourism Whitehorse and its independent travel information.
Last updated: September 6, 2026.
These Terms of Service (“Terms”) govern your use of Tourism Whitehorse, operated by The Travel Spark Company LLC (“we,” “us,” or “our”). By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.
Independent informational guide
Tourism Whitehorse is an independent informational travel guide. It is not a governmental agency, official tourism authority, emergency service, cultural authority, tour operator, travel agency, hotel, carrier, insurer, or booking provider. References to destinations, institutions, businesses, services, or providers do not imply ownership, sponsorship, endorsement, or official status.
Travel information changes
Travel conditions can change without notice. Weather, wildfire, smoke, river and trail conditions, road access, border requirements, opening hours, closures, prices, availability, accessibility, safety guidance, and operator policies may differ from published information. Confirm time-sensitive details directly with the responsible authority, institution, property, or operator before relying on them.
No professional or emergency advice
Site content is general information and is not legal, medical, financial, immigration, safety, or professional advice. In an emergency, contact the appropriate local emergency service. You are responsible for assessing your abilities, equipment, route, weather, insurance, and other circumstances before undertaking an activity.
Bookings and third-party services
Tour, hotel, or activity information may be supplied by TravelSpark, Viator, Nuitee, or another provider when an integration is configured. Prices, reviews, ratings, availability, cancellation terms, and booking links are provider data. A booking or transaction is between you and the identified provider or merchant, subject to its terms. We do not guarantee availability, provider performance, or the outcome of a third-party transaction.
Accuracy and corrections
We aim to present useful, factual-neutral information but do not warrant that every page is complete, current, or error-free. Please send a correction through the Contact page. We may edit, update, suspend, or remove content at any time.
Cultural content and respectful use
Descriptions of First Nations, cultural places, histories, names, events, and artworks require context and respect. Site access does not grant permission to reproduce cultural knowledge, artwork, language, ceremony, regalia, performances, or community materials. Follow the guidance and permissions of the relevant Nation, creator, institution, or rights holder.
Intellectual property
Unless otherwise indicated, the site’s original written content, identity, layout, and code are protected by applicable intellectual-property laws. Third-party photographs, fonts, marks, provider data, and other materials remain subject to their stated licenses and owners. Openly licensed photography is credited in the site’s third-party license information. You may link to public pages without implying endorsement.
Acceptable use
You agree not to misuse the site, interfere with its operation, attempt unauthorized access, bypass security or rate controls, introduce malicious code, scrape in a manner that harms service availability, submit unlawful or deceptive content, impersonate another person, or use the site to infringe rights. We may restrict access to protect the site or others.
User messages
If you send a message, you represent that you have the right to provide its content. Do not submit confidential business information, payment credentials, passport details, health information, or unlawful material through the general contact form. You grant us permission to process the message to respond, maintain appropriate records, and protect the service.
Disclaimer of warranties
To the fullest extent permitted by law, the site and its content are provided “as is” and “as available,” without warranties of accuracy, completeness, availability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Some jurisdictions do not permit certain exclusions, so portions of this section may not apply to you.
Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, personal travel costs, or losses arising from reliance on site content, third-party services, provider conduct, changing conditions, or inability to use the site. Nothing in these Terms excludes liability that cannot legally be excluded.
Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless The Travel Spark Company LLC and its personnel from claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the site, violation of these Terms, or infringement of another person’s rights.
Governing law and disputes
These Terms are governed by the laws of the jurisdiction where The Travel Spark Company LLC is organized, without regard to conflict-of-law principles. Any dispute will be brought in a court with lawful jurisdiction, unless applicable law requires another forum or process.
Changes, severability, and entire agreement
We may update these Terms by publishing a revised version and date. If any provision is unenforceable, the remaining provisions continue in effect. These Terms, together with the Privacy Policy and any transaction-specific third-party terms, form the agreement concerning your use of this informational site.
